Failure to Stop After an Accident and Failure to Report an Accident

'Failure to stop' happens when an accident involving a vehicle has occurred and the owner of the vehicle fails to stop at the scene, and when he or she is required to do so, does not exchange or provide their details. 'Failure to report' happens when a driver does not report the accident within 24 hours to the police. However , there are a number of possible defences and each case does depend on what happened at the time of the alleged accident. The maximum penalty for failing to stop or for failing to report is a fine not exceeding £5,000 and/ or 6 months imprisonment, although prison is unlikely except in very serious cases. If someone is found guilty of the above offences, their licence must be endorsed with between 5-10 penalty points. Disqualification is at the discretion of the court and will depend on the seriousness of the offence or if there are mitigating or aggravating factors that can be put forward.
